Dear Mr. Salem:
The Township of North Bergen (the “Township”) received your request dated 5/21/2025 under the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq.
Please be advised as of September 3, 2024, all requests submitted pursuant to OPRA must contain: (1) a certification whether the requestor has been convicted of a crime in New Jersey, any other state, or of the United States; (2) a certification regarding whether the record is being sought in connection with a legal proceeding; and (3) a certification regarding whether the record(s) sought will be used by the requestor or another person for a commercial purpose. N.J.S.A. 47:1A-5. “Commercial purpose” is defined as “the direct or indirect use of any part of a government record for . . . any use by which the user expects a profit either through commission, salary, or fee.” A requestor who intentionally fails to certify that a request is for a commercial purpose may be fined a civil penalty of $1,000 for the first offense, $2,500 for the second offense, and $5,000 for each subsequent offense.
Accordingly, your request is improper and will not be processed without the required certifications.
