Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I respectfully request access to and copies of all video recordings related to the detention and arrest of Victor Ogando-Marte on or about April 13, 2022, near Route 22 and Rock Avenue, North Plainfield, New Jersey.

Specifically, I request:

All body-worn camera footage from officers who engaged Ogando-Marte during the attempted stop, the dragging incident, the assault, and the eventual arrest.

All dash camera footage from any patrol vehicles present during the incident, pursuit, or apprehension.

Any rear seat camera footage during Ogando-Marte’s transport after being placed into custody.

The footage should include events shortly before, during, and after initial contact, Ogando-Marte’s resistance and assault, the intervention of civilians and off-duty officers, the arrest, and transport. If multiple officers or units captured footage, I respectfully request copies from each device.

If any footage is proposed for redaction or withholding, I respectfully request advance notification and a specific explanation citing the legal basis for each redaction. Given the strong public interest in ensuring transparency in violent encounters involving law enforcement and public intervention, I request that recordings be released to the fullest extent permitted under OPRA.

I respectfully request that any fees be waived, as this request is made in the public interest for news reporting and transparency purposes. If there are any fees associated with this request, please inform me before proceeding. I prefer to receive the records electronically if possible.
