Your request for final-built plans, to the extent that they exist, is
denied as per NJSA 47:1A-1.1 and Governor’s Executive Order Nos. 21 and
26, the plans themselves are exempt from disclosure since they contain
security information. If you want the information regarding the architect,
or the parts of the plan that do not show the built out – such as the
legend and title of the document, then we can check archives to see if we
have anything, and then we could send those out to a vendor for copying
(it is not something that is able to be copied in house). You would be
responsible for paying the actual cost of the fee from the vendor if you
chose to do this.
Also a request for “records,” is not a valid OPRA request. A proper
request under OPRA must identify with reasonable clarity those documents
that are desired. As per Appellate Court Division decision Elizabeth Mason
v. Hoboken - Docket No. A-0508-06T5, specificity is required for a proper
OPRA request. The court noted that OPRA was not intended to be used as a
fishing expedition or as a research tool to compile unknown documents and
that a person must know which records he or she wants and ask for those
specific documents. To the extent that what you are seeking is not
listed specifically in your OPRA request, then please let us know exactly
which document you are seeking (i.e. a resolution, an ordinance, etc.) and
a date of the document and we will be happy to search for it.
With that said, attached are the approvals, application, and other
documents that our health department had on file.
