Dear Howell Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

I am requesting these following ones regarding three (3) specific emergency responses to my residence:
911 Audio Recordings: Full audio of the 911 calls made from a residential address regarding carbon monoxide (CO) alarms on the following dates: Approximately mid to late January 2024.

CAD Logs/Abstracts: All Computer-Aided Dispatch (CAD) event logs, notes, and abstracts for these incidents, including dispatcher entries and timestamps.
Fire Incident Reports: The National Fire Incident Reporting System (NFIRS) reports and any supplemental narrative notes generated by responding fire units.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Yours faithfully,
Resident Q

Jill Abernathy, Howell Township

Good morning,

Your OPRA request has been refused as it is overly broad.

Please specify the address of the property along with the records and dates you listed below when re-applying.
A custodian is not required to research files to figure out which records, if any, might be responsive to a broad and unclear OPRA request. See Donato v. Township of Union.

When your updated request is received it will be processed.

Thank you.

Dear Jill Abernathy,

I am writing to clarify and ensure that the full scope of my previous request is met. Please be advised that this request covers two separate incidents occurring at the address I supplied in letter that I mailed to you. Please provide the Full Fire Incident Reports (NFIRS), including all 'Detailed Narratives' and 'Supplemental Remarks,' as well as the 'CAD (Computer-Aided Dispatch) Event Logs/Abstracts' for each of the following dates:
Incident #1: December 21, 2023 — CO2 emergency/resident evacuation.
Incident #2: January 1, 2024 — CO2 emergency/resident evacuation.
For each of these three incidents, please ensure the responsive records include:
Dispatcher Notes: Specifically those documenting the physical location of residents upon arrival (e.g., waiting in vehicles).
Witness/Neighbor Statements: Any notes documenting individuals or neighbors providing shelter to the residents at the scene.
Supplemental Reports: Any additional notes filed by fire marshals or responding officers documenting the scene.
Reason for Request: These records are needed to document a historical safety pattern. Thank you for your assistance in providing these specific details via electronic delivery.

Yours sincerely,

Dear Jill Abernathy,

Greetings, I’m sorry for the confusion. You are correct that I referenced three incidents; however, I realized I can only recall the specific details for two of them and don’t currently remember the third date.
I will look through my records to see if I can find it, but please proceed with the two provided for now.
Yours sincerely,

Dear Jill Abernathy,

Thank you for the update on request 26-0265.
I am writing to clarify that I was a resident at the address of the incident and was one of the individuals who called 911 for myself regarding the CO2 emergency. Therefore, I am considered an involved party in both incidents on 1/1/24.
I would like to obtain the records for 1/1/24. Please let me know the procedure for obtaining these records through the Records Bureau, and what identification I need to provide to prove I was the involved party.
I will also call the Records Bureau at 732-938-4575 to follow up as suggested.

Yours sincerely,
