The Office of the City Clerk, OPRA Unit, is in receipt of your OPRA
request below.

The attached documents are responsive to items 1 and 2 of your request.

In reference to item #3, be advised that we are unable to process your
request because it does not seek the production of an identifiable
government record, as required under OPRA.  Under OPRA the custodian of a
government record shall permit a government record to be “inspected,
examined, and copied by any person during regular business hours…”
N.J.S.A. 47:1A-5a.  Additionally, “[w]hile OPRA provides an alternative
means of access to government documents not otherwise exempted from its
reach, it is not intended as a research tool requesters may use to force
government officials to identify and siphon useful information.”  MAG
Entm’t, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534,
546 (App. Div. 2005).   Your request, as interpreted by this office, is
not a request to “search” identifiable government documents, but a request
to “research” same, and as a consequence needs further
information/clarification.   To qualify under OPRA, a request must
reasonably identify a record and not general data, information, or
statistics. Bent v. Township of Stafford, 381 N.J. Super. 30 (App. Div.
2005). Wholesale requests for general information to be analyzed,
collated, and compiled by the agency are outside OPRA’s scope. Burke v.
Brandes, 429 N.J. Super. 169, 174 (App. Div. 2012).  Please consider
revising this portion of your request by providing actual addresses for
properties that may posses violations in the areas you are seeking.

Hi,

This is a request for public records made under OPRA and the common law
right of access. I am not required to fill out an official form. Please
acknowledge receipt of this message.
Records requested:

A list of properties that currently have delinquent taxes, open property
liens, and code violations (including vacant properties). This list should
also include amounts of balances owed and the type of violation related to
each particular property.

All Request Years 2018 to 2020

Description of Information Requested:
1.Tax Account Delinquent Report
2.Detailed Lien Status Report
3.Residential code enforcement violations currently active and pending
that include:
• Residential Structures that are vacant and open to trespass
• Residential Properties with grass or weeds in excess of the city’s
height limit
• Residential Structures without a current city certificate of occupancy
• Residential Properties on the cities vacant property registry (if
applicable)
