Dear Hoboken City,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Tax Delinquent
- A list of all property addresses that have an unpaid property tax bill for the last 12 months. Please also include in the list or separately a list of properties whose property tax bill was liened against the property.
Water Shut Off / Utility Liens
- A list of all property addresses that have had their water bill liened against the property, have failed to pay their water bill, or have had the water shut off at any point in the last 10 months.
Fire Damage List
- A list of all property addresses that the fire department has received an emergency call to in the last 90 days.
Code Violation
- A list of property addresses that have received any code violations in the last 6 months
Vacant List
- A list of all properties that the city deems to be currently vacant or abandoned.

Water Shut Off – Veolia Water is a separate entity. You need to contact
Veolia Water directly @ (201-525-2335).
Code Violation and Vacant List -City does not maintain such list.
Fire Damage List - The City is in receipt of your request pursuant to the
Open Public Records Act, N.J.S.A. 47:1A-1 et seq., dated July 13, 2026.
You are requesting the following information including:
"A list of all property addresses that the fire department has received an
emergency call to in the last 90 days."
This letter is to acknowledge receipt of the request and, after
consultation with the Hoboken Fire Department and Corporation Counsel,
advise that the request, as currently written, does not identify a
specific government record and appears to seek the creation of a new
record.
Pursuant to OPRA, agencies are required to disclose identifiable
government records that already exist. OPRA does not require a public
agency to conduct research, analyze data, compile information from
multiple records, or create a new record in response to a request. See MAG
Entertainment, LLC v. Division of ABC, 375 N.J. Super. 534, 549 (App. Div.
2005).
In addition, OPRA was amended by P.L. 2024, c.16, which provides that a
records custodian is not required to fulfill a request that would require
research, the collection of information from the contents of government
records, and the creation of a new government record setting forth that
research and information. See N.J.S.A. 47:1A-5(g).Your request for a "list
of all property addresses" associated with emergency fire department calls
during the last 90 days does not identify a specific existing record
maintained by the Hoboken Fire Department. Rather, fulfilling the request
may require personnel to review numerous incident records and compile
information into a new list, which OPRA does not require.
Accordingly, the request cannot be processed in its current form. At this
time, your request does not identify the specific records sought with
sufficient clarity for this office to conduct a records search.
If you are seeking an existing government record maintained by the Hoboken
Fire Department, please identify the specific record(s) requested with
reasonable particularity.
Processing of your request is suspended pending receipt of your
clarification.
