Open Public Records Act (OPRA) Request

Reference # OPR-2025-00163

Request Type: General

Dear Nathan Stallone,

Please note the following comment made by Trina Lindsey on 4/2/2025
3:57:00 PM:

Under Daniel’s Law, records custodians are empowered with the ability to
redact from requested public information the names and home addresses of
certain persons protected by this law. By way of background, Daniel’s Law
is the title given to legislation passed in November 2020 as P.L.2020,
c.125 and legislation passed in January 2022 by P.L.2021, c.371. Daniel’s
Law amends OPRA laws to exclude from the definition of a government (i.e.,
public) record the portion of any document which discloses the home
address of any active, formerly active, or retired federal, state, county,
or municipal judge, and any active, formerly active, or retired law
enforcement officer or prosecutor, and immediate family members residing
in the same household (all described as “covered persons”). By so amending
OPRA laws, Daniel’s Law protects the identities of those covered by the
law.
Daniel’s Law’s redaction requirement for home addresses is set out in
N.J.S.A. 47:1B-2. According to that statute, public agencies:
shall redact or cease to disclose, in accordance with section 6 of
P.L.2001, c.404 (C.47:1A-5) and section 1 of P.L.1995, c.23 (C.47:1A-1.1),
respectively, the home address of a covered person approved by the Office
of Information Privacy not later than 30 days following the approval.
Daniel’s Law goes on to provide records custodians with the option of
redacting either a Covered Person’s home address, their name, or both
their name and their address. To this end, N.J.S.A. 47:1B-3(2) states in
relevant part:
a document affecting the title to real property, as defined by N.J.S.
46:26A-2, recorded and indexed by a county recording officer, or as
otherwise held or maintained by the Division of Taxation, a county board
of taxation, a county tax administrator, or a county or municipal tax
assessor, that contains an address subject to redaction or nondisclosure
consistent with this act, P.L. 2021, c. 371(C.47:1B-1 et al.)…may instead
or in addition include the redaction and nondisclosure of the names or
other information of approved covered persons, as specified by the
Director of the Division of Taxation, which redaction and nondisclosure
may include masking of such names or other information…
       (Emphasis Added).
