Due to the coordination of multiple officials for the documents cited in your Request below we will require additional time beyond the seven (7) business days to fulfill. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5.i.
We respectfully request an extension to on or before August 6, 2021.
Also, as the Borough of Matawan has had multiple Borough Administrators and members of the Governing Body (Mayor and Council) as well as multiple email platforms between 2016 to present, in order to retrieve and review archived emails of these members as they are outside the scope of normal retention and retrieval, we must use the services of our outside Information Technology vendor as well as a review of any of those emails prior to release to be conducted by the Borough Attorney. Therefore, your Request is subject to a special service charge to cover these costs. The estimate will be over $300.00 for the IT vendor alone. OPRA allows public agencies to impose special service charges whenever the nature, format, manner of collation, or volume of a government record embodies in the form of printed matter to be inspected, examined, or copied pursuant to this section is such that the record cannot be reproduced by ordinary document copying equipment in ordinary business size or when fulfilling a request requires an extraordinary expenditure of time and effort. See N.J.S.A. 47:1A-5.c. Special service charges must be based upon the actual direct cost of providing the copy or copies. OPRA mandates that the requestor shall have the opportunity to review and object to the charge prior to it being incurred. See N.J.S.A. 47:1A-5.c. Kindly respond in writing with your acceptance or rejection of this estimated charge.
We will not begin the process this portion of your Request until we receive your written acceptance.
