Dear Mr. Kuhn,
The Borough of Middlesex received your Open Public Records Act (OPRA)
request on January 14, 2021. The official Records Custodian, Linda
Chismar, received your OPRA requests on January 14, 2021. As such, the
seven (7) business day deadline to respond to your requests is January 26,
2021.
Your request sought access to the following:
1. All Code Violations
2. All Tax Delinquents/Liens
3. All Vacant/Abandoned Properties
4. All Utility Delinquent/Liens (if applicable)
Please be advised that your request for government records is overly
board. When a request does not name specifically identifiable records or
is overly broad, a custodian may deny access pursuant to the following
court decisions: MAG Entertainment, LLC v. Division of Alcoholic Beverage
Control, 375 N.J.Super. 534 (App. Div. 2005). A proper request under OPRA
must identify with reasonable clarity those documents sought. A custodian
is obligated to search and a find the identifiable government records
listed in the Complainant's OPRA request. A custodian is not required to
search her files to figure out which records, if any, might be responsive
to a broad and unclear OPRA request. Please provide dates or time frame
of the records sought so that we may process your request.
