OPRA - police officer-involved lawsuits 2012-2019
Dear Emerson Borough,
This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:
1. A list of all lawsuits and cases in which any officer of the police department was involved between 2012 and 2019. For each lawsuit/case, please provide the date (month and year) of the alleged incident at issue, whether the alleged incident was excessive force, settlement amount (if any), and final compensation amount ruled (if any).
2. Please provide copies of the complaint in any lawsuits and cases described in above.

Good afternoon,
In response to your request; the claim report attached shows 4 police
cases over this time period.
No claim went into suit, therefore, I do not have any S&C to attach.
There were no settlements in any of the files from Bergen JIF.
Pottinger: responded to his apartment on domestic violence call; landlord
gave them key and permission to enter; he was questioned; and police left
Jeffrey Scott: 262-HELP called Police to assist in involuntary commitment;
clmt had to be secured and taken to Bergen Regional.
Marin: 9/26/12 HE WAS ON NJT PROPERTY LOOKING INTO UTILITY BOX THEN
SCOPING OUT PARKED CARS; ARRESTED ON OUTSTANDING WARRANTS
Marin: 5/9/13 allegedly detained and given trespass ticket. Nothing more
than a 1 paragraph letter.
