OPRA - police officer-involved lawsuits 2012-2019

We're waiting for Taeho Kim to read recent responses and update the status.

Dear Clifton City,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

1. A list of all lawsuits and cases in which any officer of the police department was involved between 2012 and 2019. For each lawsuit/case, please provide the date (month and year) of the alleged incident at issue, whether the alleged incident was excessive force, settlement amount (if any), and final compensation amount ruled (if any).

2. Please provide copies of the complaint in any lawsuits and cases described in above.

Yours faithfully,

UC Research

Liss, Ron, Clifton City

In response to your OPRA request dated and received on 05-28-20, regarding
all lawsuits and cases in which any officer of the police department was
involved between 2012 and 2019, this is to inform you that we need an
extension to 06-18-20 to respond further to your request.  Please respond
back stating your willingness to grant this extension.

Thank you.

Attached please find copies of records that are in partial response to
your OPRA request stated above.  Please excuse the delay in responding to
your request, as it has been due to the COVID-19 outbreak and its impact
on normally available resources, as we are working on a limited basis due
to this crisis.  The attached copies are from computer based resources
that are remotely accessible by our Law Department staff who are mostly
working from home.  Once we return to normal operation, a search can be
made of legal files and records in storage here in Clifton City Hall for
the balance of responsive records.  We will need at least seven business
days following this return to provide these records.

The following is in further response to your OPRA request dated 05-27-21,
received on 05-28-21 and initially responded to in my e-mail of 06-04-21,
in which I stated that we needed an extension to respond further to your
request.  Although I did not receive a response from you as to whether or
not you were willing to grant the extension, I sent you the attached
e-mail on 06-25-21 in partial response to your request.  In view of the
foregoing, please respond back as to whether or not the records that have
been provided satisfy your request.

Sincerely,

Taeho Kim:

This is in follow-up to my previous e-mail in this chain.  (Please note
that I inadvertently used “21” dates in that e-mail instead of “20”
dates.  I apologize if this caused any confusion.)  I am again requesting
that you respond back as to whether or not the records that have been
provided satisfy your request, since I have not heard from you in this
regard in response to my previous e-mail.  If I do not receive a response
from you by 06-04-21, we will close out this OPRA request effective that
date.

Sincerely,
