OPRA - police officer-involved lawsuits 2012-2019

We're waiting for Taeho Kim to read recent responses and update the status.

Dear Bayonne City,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested:

1. A list of all lawsuits and cases in which any officer of the police department was involved between 2012 and 2019. For each lawsuit/case, please provide the date (month and year) of the alleged incident at issue, whether the alleged incident was excessive force, settlement amount (if any), and final compensation amount ruled (if any).

2. Please provide copies of the complaint in any lawsuits and cases described in above.

Consistent with the State of New Jersey's most recent directive regarding
OPRA requests, please be advised that the satutory deadline (7 business
days) does not apply during this current State of Emergency.  Consistent
with said directive, however, Bayonne's

custodian of government records shall make a reasonable effort, as the
circumstances permit, to respond to a request for access to a government
record within seven business days or as soon as possible thereafter. 
Given our current reduced staffing levels during this State of Emergency,
we will endeavor to have your request answered as soon as possible, but we
project that certain requests will take up to 30 days to fulfill.  Thank
you for your understanding and patience.

HelloTaeho, based upon the broad scope of your request, it is likely that a special service charge will be imposed in order to produce the requested records. Although you are not required to narrow your request, it may help to reduce the cost incurred in producing the requested records. For example, your request currently would include all workers compensation matters involving police officers. If it is not your intent to request those records, please advise. Similarly, your request would include all matters involving property damage, employment claims and auto liability matters. If it is not your intent to include such records, it is suggested that you submit a revised request.

If we do not hear from you with an amended request by June 2, 2020, "we will assume your request will not be amended and we will provide you with the estimate of the costs to produce the requested records.”

Juvenile Records: Pursuant to N.J.S.A. 2A:4A-60 states, social, medical,
psychological, legal and other records of the court and probation
division, and records of law enforcement agencies, pertaining to juveniles
charged as a delinquent or found to be part of a juvenile-family crisis,
shall be strictly safeguarded from public inspection. 

 

Information relating to medical, psychiatric or psychological history,
diagnosis, treatment or evaluation is exempt from disclosure as a medical
record pursuant to Executive Order No. 26 (McGreevey 2002).

 

Eight (8) records have not been released pursuant to N.J.S.A. 2C:25-33
(“Prevention of Domestic Violence Act of 1991”), which states that all
records maintained pursuant to this act shall be confidential and shall
not be made available to any individual or institution except as otherwise
provided by law.
