We're waiting for LTown United to read a recent response and update the status.

Dear Livingston Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

All emails received at the address [email address], together with any attachments, sent during the period May 15, 2024 through November 15, 2024, inclusive.

This address is a dedicated public-comment channel through which members of the public submit comments and correspondence to the Township and/or its governing body. Accordingly, the records sought are a discrete, self-defining record set — the full contents of a single, purpose-built mailbox over a defined six-month window — not a topical search across general correspondence. Identifying responsive records requires no content-based review or judgment by the custodian: every email in the mailbox is, by the inbox's own design, a public comment. The request therefore satisfies the criteria of Elcavage v. West Milford Twp., GRC No. 2009-07 — it specifies the recipient (the [email address] mailbox), a date range, and a subject matter (public comments submitted to that address) — and presents none of the "research versus search" burden the subject-matter criterion exists to prevent.

Format: Please provide the responsive records as a native electronic export (e.g., .eml, .msg, .mbox, or PDF) delivered electronically. A bulk export of the mailbox for this period, with a single redaction pass, is both adequate and the least burdensome method of production; I am not requesting paper copies or individualized per-email handling.

Redactions and fees: I recognize that, under the 2024 amendments, the Township may redact personal identifying information of private senders (such as personal email and home addresses). This request covers a narrow six-month window encompassing only a handful of public meetings, so the responsive set is expected to be modest in volume. A bulk export with a redaction pass over so limited a record set does not warrant a special service charge. If the Township nonetheless intends to assess one, please notify me in advance and in writing, with an itemized basis identifying the specific tasks and time involved, before performing the work — so that I may either contest the charge or narrow the request further. Please do not incur any charge without prior authorization.

Withholdings: If any record or portion is withheld, please provide a written, document-by-document index identifying each withheld item and the specific lawful basis for the withholding.

Certifications: This request is not made for a commercial purpose. This request is not connected to any legal proceeding to which I am a party and does not seek records subject to a pending court order or discovery request.

Please acknowledge receipt and respond within seven (7) business days as required by N.J.S.A. 47:1A-5(i). If you intend to deny any part of this request, please cite the specific statutory or regulatory basis for the denial.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
