This is a request for public records made under OPRA and the common law right of access. Please acknowledge receipt of this message.
Records requested:
The following records are being requested in regards to the school board investigation conducted by DAR Associates of Beachwood, New Jersey between the dates of July 1, 2017 and February 6, 2018:
1) Copies of all investigative summaries and reports delivered by DAR associates to any of the following: School Board Attorney Stephan Leone, Attorney Vincent J. Grasso, Board Member Ben Giovine, Superintendent David M. Healy. Document should include report and all corresponding addendums, exhibits and attachments.
2) Copies of emails sent by DAR associates to School Board Attorney Stephan Leone, Attorney Vincent J. Grasso, Board Member Ben Giovine, Superintendent David M. Healy. Document should include report and all corresponding addendums, exhibits and attachments.
3) Copies of emails sent to and/or from Ben Giovine during this period which contain the following keywords and/or subject matter: Investigation, Onofrietti, Raimann, Superintendent, Healy, sexual harassment, leaked email, leaked, njea, union that pertain to the subject matter of the investigation by DAR associates and/or to the subject matter of leaked confidential documents.
4) Copies of emails sent to and/or from Christopher Raimann during this period which contain the following keywords and/or subject matter: Investigation, Onofrietti, Raimann, Superintendent, Healy, sexual harassment, leaked email, leaked, njea, union that pertain to the subject matter of the investigation by DAR associates and/or to the subject matter of leaked confidential documents.
5) Copies of all reports, including financial reports, delivered and/or on file with the Toms River School District regarding the investigation conducted by DAR associates.

Good Afternoon Mr. Stilton, in response to your OPRA request received
February 6, 2018 please see the response below.
Request #1 The request for the DAR report is denied as same is exempt
under NJSA 47:1A -1.1(1) as intra-agency advisory material related to
personnel matter and NJSA 47:1A-1.1(7) as attorney-client privilege.
Requests #2, #3 and #4 are denied as exempt under NJSA:47:1A-1.1(1) as
intra-agency advisory or consultative materials and NJSA 47:1A-1.1(12)(a)
as information generated in connection with a sexual harassment complaint
filed with a public employer.
Request #5 is denied for the reasons set forth under request #1 and there
are no financial reports delivered and/or on file with TRSS regarding the
DAR investigation.
