Monroe BOE Watchdog

Dear Monroe Township School District (Middlesex),

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.

Records requested: All emails to/from: Chrissy Skurbe (Monroe Twp BOE Member) and Kyle Anderson (County Executive Superintendent). 01/01/2022-05/31/2022.

Yours faithfully,

Monroe BOE Watchdog

Reeshemah Zielinski, Monroe Township School District (Middlesex)

The Board is in receipt of your Open Public Records Act ("OPRA") request. Your request requires additional time to respond due to the significant demands placed on the District with regard to the COVID-19 pandemic, and OPRA requests. OPRA allows custodians to seek extensions of time pursuant to N.J.S.A. 47:1A-5(i). Specifically, OPRA states that “the requestor shall be advised by the custodian when the record can be made available. If the record is not made available by that time, access shall be deemed denied.” Accordingly, your request requires an extension of time until June 27, 2022.

Dear Monroe BOE Watchdog,

The District is in receipt of your request for records under the Open
Public Records Act. Specifically, your request sought "All emails to/from:
Chrissy Skurbe (Monroe Twp BOE Member) and Kyle Anderson (County Executive
Superintendent). 01/01/2022-05/31/2022." Your request requires further
clarification. The Government Records Council ("GRC") has established
specific criteria that must be met for a requestor to identify specific
government communications. The GRC determined that to be valid, the
request must contain: (1) the content and/or subject of the communication,
(2) the specific date or range of dates during which the communications
were transmitted, and (3) the identity of the sender and/or the recipient
thereof. Elcavage v. West Milford Twp., GRC Complaint No. 2009-07 (April
2010); Caggiano v. NJ Office of the Governor, Complaint No. 2014-263
(March 2015). Your request fails to provide the requisite information to
identify a specific government communication. As a result, your request is
denied, at this time, until further clarification is provided.

Thank you,

Lisa Goldstein
