Please be advised that a search for responsive electronic records
containing the e-mail extension “njleg” in the “To” and “From” lines has
returned approximately 1,000 generic statewide notices and alerts. The
Borough is continuing to gather these records. Included in this search
are Borough specific e-mails which are attached hereto. Please accept
these records as a partial response to your request. Please note that
these records were redacted where indicated to remove confidential and
personal information including personal addresses, personal e-mail
addresses, personal cellphone numbers, and personal family photo attached
to e-mail dated January 22, 2023 (8:52 AM). These redactions were made
because there is a reasonable expectation of privacy sufficient to
preclude release of said information. They were made pursuant to N.J.S.A.
47:1A-1.1 (personally identifying information); N.J.S.A. 47:1A-1 (“…a
public agency has a responsibility and an obligation to safeguard from
public access a citizen's personal information with which it has been
entrusted when disclosure thereof would violate the citizen's reasonable
expectation of privacy…”); Burnett v. County of Bergen, 198 N.J. 408
(2009)(citizens have a reasonable expectation of privacy in their personal

Mr. Kolbe,
As a follow up to our prior communications, the Borough contacted its IT
vendor to inquire whether it would be able to extract the specific
electronic fields you requested, separate and apart from the estimated
1,000 individual, generic statewide e-mails it received over a 3.5-year
period relating to your request. We have been advised that IT cannot,
from a technological standpoint, extract or otherwise isolate the specific
electronic fields you requested. Despite this technical obstacle, and in
a continued effort to accommodate your request, the Borough identified
approximately 1,000 e-mails containing the e-mail extension “njleg” in the
“To” or “From” lines which it can provide to you. However, each e-mail
will need to be inspected to remove redactions in accordance with law
prior to their release.
Under these circumstances, the Borough believes that any further
processing of your request would be substantially disruptive to the
Borough and may necessitate a special service charge. In an effort to
reach a reasonable accommodation of your request, we therefore propose to
discuss with you in detail your research goals and how any responsive,
releasable records in the Borough’s possession, custody, or control could
help you achieve those goals without causing substantial disruption to the
Borough or necessitating the imposition of a special service charge. To
that end, the Borough asks that you contact the Borough Clerk to schedule
a meeting or telephone conference at your convenience to address these
issues in relation to your request.
In light of the foregoing, the Borough requests an extension of time,
pending further discussions with you, to complete its response.
