This single request is directed to the Division of Criminal Justice (DCJ), the Police Training Commission (PTC), and the Office of the Chief State Medical Examiner (OCSME, NJDOH). This request seeks not only records created by your agency, but also any responsive records received from another agency in the course of official duties that remain in your custody.

Context

This request relates specifically to the Forensic Urine Drug Testing Custody and Submission Form (FUDT CSF v230301). That form includes an “8-Drug Panel” test option and a separate checkbox for Marijuana/Cannabis. I seek records that define and explain what the “8-Drug Panel” consists of when this form is used in law-enforcement testing.

Records Requested
1. Policies & Guidance (2021–Present, Still in Effect)
• Any policies, directives, manuals, bulletins, memoranda, or guidance documents (2021–present, still operative) issued by DCJ, PTC, or OCSME that define the composition of the “8-Drug Panel” or govern when marijuana/cannabis is tested.
• Any supplements, updates, or training materials provided to law-enforcement agencies that address marijuana/cannabis testing, including federal-task-force triggers, reasonable suspicion standards, or federally regulated license requirements.
2. Attorney General Policy / Directives
• The Attorney General’s Law Enforcement Drug Testing Policy (all versions from 2021–present that remain operative).
• Any Attorney General directives, notices, bulletins, FAQs, or guidance (2021–present, still operative) that define the substances in the “8-Drug Panel” or explain marijuana/cannabis testing conditions.
3. Laboratory-Related Records
• The current test menu, analyte list, laboratory manual excerpt, or equivalent record that defines the substances included in the “8-Drug Panel.”
• Any FUDT CSF v230301 instructions, user guides, or explanatory materials that clarify the panel’s composition and whether marijuana/cannabis is part of it by default or must be separately selected.
• Any inter-agency communications (2021–present, still operative) held by DCJ, PTC, or OCSME concerning the “8-Drug Panel” or marijuana/cannabis testing.

Clarification in Lieu of Documents

It is recognized that OPRA does not itself provide for “questions.” However, agencies have at times, in the interest of transparency and to lessen strain on staff, provided clarification or direct answers where doing so functionally satisfied a records request.

Accordingly, if producing responsive records in full is not feasible, this request may also be satisfied by answering the following:
1. Whether marijuana/cannabis is included in the “8-Drug Panel” option shown on the FUDT CSF v230301, or, in the alternative, which substances make up the “8-Drug Panel.”
2. Whether the State of New Jersey, through the Department of Law and Public Safety, requires law-enforcement officers and applicants (including entry-level, lateral, or otherwise) to be tested for marijuana/cannabis, and if a positive result mandates termination or disqualification from employment.

Any such response will be treated as responsive to this request.
