OPRA BWC records
Dear Stafford Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
To the Records Custodian,
Pursuant to the New Jersey Open Public Records Act (OPRA), N.J.S.A. 47:1A-1 et seq., I respectfully request access to government records maintained by the Stafford Township Police Department.
Specifically, I request body-worn camera (BWC) footage and related records for incident number ST24-09926, dated February 5, 2024.
For this request, please provide:
1. All BWC footage recorded in connection with this incident by any supervisory officer who arrived on scene or otherwise participated in the incident.
2. All BWC footage recorded by any officer who submitted an overtime entry related to this incident.
3. The total number of BWC video files per officer.
4. The file size of each BWC video, or alternatively the total file size and duration of all BWC footage per officer.
If any BWC footage is deemed exempt from disclosure, please provide in lieu thereof:
1. The file size and video duration for each withheld BWC recording and name of officer.
Additionally, please identify any officer(s) who submitted an overtime entry indicating that they worked this incident but did not activate their BWC, and provide any records reflecting the reason for non-activation.
If the requested records are maintained in electronic format, I prefer to receive them electronically via a download link or other reasonable digital method.
If fulfilling this request will require a special service charge due to the volume, format, or extent of the request, please advise me of the estimated cost in advance before processing.
If any portion of this request is denied, please provide the specific legal basis for the denial, including the statutory citation, and release any reasonably segregable portions of responsive records.
