Dear Mr. Rozzi:

 

The Office of the State Comptroller (OSC) received your Open Public
Records Act (OPRA) request C134618 on July 10, 2018. As such, the seven
(7) business day deadline to respond to your request is July 19, 2018.
This response is being provided to you on July 19, 2018, the 7^th business
day after the custodian’s receipt of said request.

 

Your OPRA request sought access to the following documents:

 

“For the period of August 1st, 2017 to July 10th, 2018, please provide
copies of all emails sent or received by[:]  Philip Degnan, Robert Shane,
Joshua Lichtblau, Kay Ehrenkrantz, Robert Graves regarding the following
keywords: ‘Operation Blue Claw’  ‘OP Blue Claw’  ‘OBC’.”

 

Your request is denied because it seeks documents considered advisory,
consultative or deliberative; such documents are exempt from disclosure
under OPRA pursuant to N.J.S.A. 47:1A-1.1.  Your request is also denied
based on the privacy exception to disclosure under OPRA.  See N.J.S.A.
47:1A-1; Burnett v. County of Bergen, 198 N.J. 408, 427-428 (2009); In the
Matter of the State Fireman’s Association Obligation to Provide Relief
Applications Under the Open Public Records Act, 230 N.J. 258, 277 (2017).

 

You also seek such records pursuant to the common law right of access. 
However, because the OSC’s interest in protecting confidential records
from disclosure outweighs the requestor’s interest in accessing such
records, your request is hereby denied.  

 

In addition to the reasons for denial set forth above, OSC reserves the
right to supplement the reasons with any additional basis for exception to
public access as may hereinafter also be determined to apply.
