Dear Charlie Kratovil,

to process and locate responsive documents. OPRA allows custodians to seek
extensions of time pursuant to N.J.S.A. 47:1A-5(i). Specifically, OPRA
states that, “the requestor shall be advised by the custodian when the
record can be made available. If the record is not made available by that
time, access shall be deemed denied.”

Please allow this email to acknowledge receipt of your request for
“meetingminutes for the Open Space & Recreation Public Advisory
Committee,including any reports, resolutions, agendas, and other
supporting documentationin the packet for committee members, for meetings

Given the near decade of timethis request entails, this request is
estimated to take an extraordinary amountof time to fulfill due to the
volume of documents. OPRA allows public agenciesto impose special service
charges whenever the nature, format, manner of collation,or volume of a
government record embodied in the form of printed matter to beinspected,
examined, or copied pursuant to this section is such that the recordcannot
be reproduced by ordinary document copying equipment in ordinarybusiness
size or when fulfilling a request requires an extraordinaryexpenditure of
time and effort. See N.J.S.A. 47:1A-5(c). Special servicecharges must be
based upon the actual direct cost of providing the copy orcopies. Due to
the nature of your request, an extraordinary expenditureof time is
estimated in order to fulfill your request.
Below represents a breakdown of the estimated time and materials to
beexpended:
Total hours estimated to compile documents: 100
Employee hourly rate: $33.63
The total estimated amount due tofulfill this request is $3,363.00. Please
advise if you agree to payment ofthis special service charge. Upon receipt
of payment, the County will begin toprocess your request. Please have the
payment mailed to my attention madepayable to “Treasurer, Middlesex
County” and please reference OPRA #W018473-092723 on the payment. If less
time is required to fulfill thisrequest, the difference will be returned
to you. If no response is receivedwithin seven (7) days, the County will
consider this request withdrawn and willclose the request. Or, if you
wish to revise your request to limit thescope of records that will need to
be provided, please advise accordingly.

Dear Ms. Berry,
I don't understand why an extension was required for this kind of response. On October 3, the county stated the extension was needed "to process and locate responsive documents," not to develop a price quote for the public records I've requested. Why have no records been produced as of today, October 20?
The county now says it will require payment to "process" the request? Respectfully, what has the county been doing to fulfill the request between October 3 and today?
Nevertheless, at this time, I would like to narrow the scope of my request. Please produce the records requested only for this calendar year (2023) and the prior calendar year (2022). I trust you can provide that much at no charge. Please kindly confirm this.
