Open Public Records Act (OPRA) Request – N.J.S.A. 47:1A-1 et seq.
Dear Rockaway Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
A complete organizational chart and detailed breakdown of the police department, including delineation of roles and responsibilities of the command staff, supervisory personnel, and rank-and-file officers.
The current resume, curriculum vitae, and all certifications and trainings for the Chief of Police, as required by the applicable municipal ordinance.
The current resume, curriculum vitae, and all certifications and trainings for the Deputy Chief, as required by the applicable municipal ordinance.
The current resumes, curricula vitae, and all certifications and trainings for the two Captains, as required by the applicable municipal ordinance.
The current resumes, curricula vitae, and all certifications and trainings for the four Lieutenants, as required by the applicable municipal ordinance.
All documentation or descriptions outlining the process by which officers are assigned to the Detective Bureau, including but not limited to any testing, interviews, or performance-based criteria used in the selection process.
Statistical records for each of the following individuals: Chief, Deputy Chief, Captains, Lieutenants, and Sergeants, reflecting the number of probable cause arrests, warrant arrests, summonses issued, and motor vehicle stops initiated over the past ten (10) years.
The total number of career self-initiated arrests for each of the aforementioned individuals.
A record of all internal investigations opened against every sworn member of the police department during their careers and its outcome (e.g., sustained, exonerated, not sustained, unfounded), identified individually.
Please provide these records in electronic format if available. If any portion of this request is denied, please provide the legal basis for such denial pursuant to N.J.S.A. 47:1A-1, and identify the records or portions thereof being withheld.

It is not the responsibility of the Records Custodian to create records
when none are maintained in the manner requested.
8. Your request for “… all internal investigations open against
every sworn member of the police department during their careers and its
outcome …” is overly broad. Additionally, such records are exempt from
OPRA access pursuant to the Attorney General’s Internal Affairs Policy.
Access to such records may be granted under the common law right of
access; however, in order to determine whether such access is appropriate,
an evaluation would have to be made pursuant to the factors enunciated in
Rivera v. Union County Prosecutor’s Office, 250 N.J. 124 (2022), as to
each matter. Such an evaluation will require the imposition of a Special
Service Charge and, in the event, you wish to maintain your request, it
will be necessary for you to post a deposit in order to commence the
process of records retrieval and evaluation. If you wish to maintain your
request, please advise this office and you will be advised of the required
deposit.
If we do not hear back from you regarding the Special Service Charge, we
shall consider this request closed.
