Access to Government Records Under the New Jersey Open Public
Records Act (N.J.S.A. 47:1A-1 et seq.)
1. The fees for duplication of a government record are specified
below. We will notify you of any special charges, special service
charges or other additional charges authorized by Borough
ordinance or regulation before processing your request. Payment
shall be made by check or money order payable to the Borough of
Oceanport and mailed to Borough Clerk - OPRA, PO Box 370,
Oceanport, NJ 07757
$.05 per page for letter (8 ½ x 11) size pages and smaller
$.07 per page for legal (8 ½ x 14) and ledger (11x17) size pages
and larger
$.25 per additional page for color copies (sizes above)
Costs for reproduction that must be outsourced will be charged at
the cost incurred by the Borough. If the actual cost to produce a
copy of a record exceeds the above fees, then the cost will be
calculated by the formula set forth by the Government Records
Council.
Postage costs will be charged for any mailed documents.
2. Pursuant to OPRA (C.47:1A-5c & C47:1A-5d), the Borough will
apply special service charge for any extraordinary expenditure of
time and effort to accommodate a request. The special service
charge will be based on the actual direct cost of providing the
records. The requester shall have the opportunity to review and
object to the charge prior to it being incurred however, in the
event the requester objects to the special service charge, the
request will be closed and access to the records will not be
granted.
3. By law, the Borough must notify you that it grants or denies a
request for access to government records within seven business
days after the custodian of the record requested receives the
request, provided that the record is currently available and not
in storage. If the record requested is not currently available or
is in storage, the custodian will advise you within seven business
days when the record can be made available and the estimated cost.
You may agree with the custodian to extend the time for making
records available, or granting or denying your request.
4. You may be denied access to a government record if your request
would substantially disrupt agency operations and the custodian is
unable to reach a reasonable solution with you.
5. If the Custodian was unable to comply with your request for
access to a government record, the custodian will indicate the
reasons for denial in the response.
6. Except as otherwise provided by law or by agreement with the
requester, if the custodian of the record requested fails to
respond to you within seven business days of receiving a request
form, the failure to respond will be considered a denial of your
request.
7. Resolution of Disputed Findings: In the event that a requester
does not agree with the Custodian's record response, the requester
should:
No Records - Reexamine the request details to evaluate if all of
the information was provided that could aid the Custodian in
locating records. The Borough's ability to identify records of
interest is in direct correlation to matching the Borough
information with the information provided on the request.
Denial - If your request for access to a government record has
been denied or unfilled within the time permitted by law, you have
a right to challenge the decision by the Custodian to deny access.
The Custodian denies access to records only when those records do
not meet the definition of a government record and/or public
access is not allowed pursuant to the law. At your option, you may
either:
a. Contact the Borough Clerk to re-visit the matter or provide
further explanation.
b. Institute a proceeding in the Superior Court of New Jersey
c. File a complaint in writing with the Government Records Council
(GRC). You may contact the GRC by toll-free telephone at
866-850-0511, by mail at PO Box 819, Trenton, NJ, 08625, by e-mail
at [email address], or at their web site at
www.state.nj.us/grc. The Council can also respond to other
questions about the law.
8. Information provided on this form may be subject to disclosure
under the Open Public Records Act.

OPRA-Req-25-0435
Date Received: 12/1/2025
Status: Received
Applicant: Corinne Thygeson
Information Requested: 15 Signal Avenue - Open and Closed Permits
RESPONSE:
OVERLY BROAD
RESPONSE:
Please note that your request for" open and closed permits" is
overly broad and does not identify a specific document, topic,
type, department/subject. A valid request identifies the specific
record being sought for example "a copy of the construction
permits issued for the period Jan. 1, 2010 to February 1, 2020".
OPRA is not intended for research but to provide specifically
identified records so that the Custodian may provide access to
that record pursuant to the following court decisions: MAG
Entertainment, LLC v. Division of Alcoholic Beverage Control, 375
N.J.Super. 534 (App. Div. 2005), Bent v. Stafford Police
Department, 381 N.J. Super. 30 (App. Div. 2005), New Jersey
Builders Association v. New Jersey Council on Affordable Housing,
390 N.J. Super. 166 (App. Div. 2007), and Schuler v. Borough of
Bloomsbury, GRC Complaint No. 2007-151 (February 2009).
Due to the reasons stated above, the Borough finds your request to
be overly broad and denied. Requestor is invited to submit a new
request that is more specific to the records you are seeking.
Sincerely,
Borough Clerk
If your request for access to a government record has been denied
or not responded to within the seven (7) business days required by
law, you have a right to challenge the decision by the Oceanport
Records Custodian to deny access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file
a complaint with the Government Records Council (GRC) by
completing the Denial of Access Complaint Form. You may contact
the GRC by toll-free telephone at 866-850-0511, by mail at P.O.
Box 819, Trenton, NJ, 08625, by e-mail at [email address], or
at their web site at www.state.nj.us/grc. The GRC can also answer
other questions about the law. All questions regarding complaints
filed in Superior Court should be directed to the Court Clerk in
your County
