Dear Middlesex County,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

All policies within the county law enforcement including Proscutor Office, Sheriff Office and Corrections Office regarding officers issued firearms while claiming disability from the military and collecting disability pensions for physiological issues.

Are they required to report their disability award and are they sent for a new psychiatric evaluation upon learning of issues not reported when hired

I write in response to your public records request seeking: “All policies
within the county law enforcement including Proscutor [sic] Office,
Sheriff Office and Corrections Office regarding officers issued firearms
while claiming disability from the military and collecting disability
pensions for physiological issues.”
 
As an initial matter, your request is not a valid request under OPRA as it
calls for research rather than a search of public records. Bent v.
Township of Stafford Police Dep’t, 381 N.J. Super. 30 (App. Div. 2005),
Burke v. Brandes, 429 N.J. Super. 169 (App. Div. 2012), and Burnett v.
County of Gloucester, 415 N.J. Super. 506 (App. Div. 2010). While
statutory law and regulatory law and common law practices may govern the
factual scenario described in your request, the above-referenced law
enforcement agencies do not have any policies specifically addressing that
scenario and consequently there are no records responsive to your request.
