Dear Livingston Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Email complaints about Officer Drumm JR made by Officer Brian Baker in October 2024 to Det/Lt Vincent Daly

If records are deemed confidential a vaughn index with date and time of emails is requested

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Yours faithfully,

Sam B

In response to your OPRA Request for:

"Email complaints about Officer Drumm JR made by Officer Brian Baker in
October 2024 to Det/Lt Vincent Daly".

Please see the attached Vaughn Index, responsive records are exempt from
disclosure pursuant to a. § 47:1A-10. Personnel, pension records not
considered public information; exceptions. Specifically, the OPRA requests
“complaints” made against a Township employee, which by definition
constitute “records relating to any grievance filed by or against an
individual” which, under  N.J.S.A.§ 47:1A-10, expressly “shall not be
considered a government record and shall not be made available for public
access.” b. § 47:1A-9. “Other laws, regulations, privileges unaffected”
and N.J. Stat. § 40A:14-181

The Township has not been provided with sufficient information to evaluate
the Common Law requests.  Specifically for a Common Law records request
“(1) 'the person seeking access must establish an interest in the subject
matter of the material'; and (2) 'the [person's] right to access must be
balanced against the State's interest in preventing disclosure.'" See:
Rivera v. Union County Prosecutor's Office, 250 N.J. 124 (2022)

The  requests submitted have no information whatsoever as to the
requestor’s interest in the subject matter, rendering it impossible for
the Township to balance that interest and the requestor’s right to access
against the Township’s interest in preventing disclosure.
