Officer Baker Tort Claim Notice
Dear Livingston Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

In response to your OPRA Request for:
"Tort Claim filed by Officer Brian Baker on or around May/June 2025".
The requested Tort Claim Notice, with appropriate redactions is produced
herewith. Please see the attached Vaughn Index of responsive files that
are exempt from disclosure.
With the exception of the redacted Tort Claim Notice produced, the
Township has not been provided with sufficient information to evaluate the
Common Law requests. Specifically for a Common Law records request “(1)
'the person seeking access must establish an interest in the subject
matter of the material'; and (2) 'the [person's] right to access must be
balanced against the State's interest in preventing disclosure.'" See:
Rivera v. Union County Prosecutor's Office, 250 N.J. 124 (2022)
The requests submitted have no information whatsoever as to the
requestor’s interest in the subject matter, rendering it impossible for
the Township to balance that interest and the requestor’s right to access
against the Township’s interest in preventing disclosure.
