1. Handwritten notes by Andrea Kornick, Board Member, during the Board of
Education meeting on January 5, 2022 and January 24, 2022.
Board Member will not be providing any hand written notes. Typically a
board member can take their own memory aids and they are not subject to
release.  
2. Text messages sent to and from Andrea Kornick during the Board of
Education meeting on January 5, 2022 and January 24, 2022.
Board Member stated that the only texts sent or received during the
meetings were between her husband and herself regarding who would be
picking up their child. Text messages will not be provided because they
are personal and not Board related.
3.  Social media posts by Andrea Kornick on Facebook from January 5, 2022
through February 6, 2022 regarding Board and Medford school district
related matters.
Board Member stated that she will not be providing any of her personal
Facebook posts. Board Member responded "My social media accounts are
private accounts and they are not used to conduct any "official business"
for the Board of Education.  Official business is defined as "those duties
which are imposed by law as well as those which are clearly inherent in
and naturally arise from the nature of the office".  Additionally, the
Reopen Medford Township Schools page that I am an administrator for, which
was created prior to my election to the Board, is not characterized as an
official school board member page.  The page is not used for the purpose
of official business, nor is there any public business conducted on the
page, and none of the posts contain specific details about my work as a
BOE member.  Therefore none of the posts that I have made on my personal
page or on the Reopen page are government record and they are not subject
to OPRA or Common Law Right of Access.  Case Law References: West v.

4.  A copy of the oath of office signed by Andrea Kornick on January 5,
2022.
Not subject to OPRA.  N.J.S.A. 47:1A-1.1 exceptions “A government record
shall not include the following information which is deemed to be
confidential for the purposes of P.L.1963, c.73 (C.47:1A-1 et seq.) as
amended and supplemented: … any copy of an oath of allegiance, oath of
office or any affirmation taken upon assuming the duties of any public
office, or that oath or affirmation, taken by a current or former officer
or employee in any public office or position in this State or in any
county or municipality of this State, including members of the Legislative
Branch, Executive Branch, Judicial Branch, and all law enforcement
entities, except that the full name, title, and oath date of that person
contained therein shall not be deemed confidential.”

January 5, 2022 to February 6, 2022.  This includes any personal account
that may have been used for communication of board related matters.
Under OPRA, a proper request for communications must focus upon the
following four (4) characteristics:

•           Content and/or subject

•           Specific date or range of dates

•           Sender

•           Recipient

In order to specifically identify an e-mail, OPRA requests must contain
(1) the content and/or subject of the e-mail, (2) the specific date or
range of dates during which the e-mail was transmitted or the emails were
transmitted, and (3) a valid e-mail request must identify the sender
and/or the recipient thereof. Here, your requests lack at least one of the
above characteristics making each an invalid OPRA request.
