The subject line and body of your below email appears to be referring to the email I sent to you earlier today wherein I indicated that I had not received your request for the following records until today: "(1) Emails to and from AP Lesley Snock regarding defendant Jason Samaritano from February 1, 2023 to February 28, 2023, including the SUBJECT, TO, FROM, TIME, COPIED INDIVIDUALS and ALL ATTACHMENTS
(2) Emails to and from AP Lesley Snock regarding defendant Jason Samaritano from March 1, 2023 to 31, 2023, including the SUBJECT, TO, FROM, TIME, COPIED INDIVIDUALS and ALL ATTACHMENTS". However, the email chain below the email you just sent me is in response to the separate email I sent you earlier today as a follow up to the response you received from this office on October 11, 2023 to your records request dated October 1, 2023.
With regard to your OPRA request which I only just received today, October 16, 2023, I am also unaware of why your request was not received until today - however, following the reasonable seven day extension of the time frame for responding to this OPRA request which I posed earlier today, you can expect to receive a response to this request along with all responsive records on or before October 24, 2023. In the interest of making sure that all of your requests are coming through, I am currently in receipt of OPRA requests from you that are still pending responses dated (1) October 7, 2023, (2) October 7, 2023, (3) October 14, 2023, (4) October 14, 2023, (5) October 15, 2023 and (6) October 16, 2023. If you are aware of any additional requests that you have posed that I have not accounted for here, please let me know.
With regard to the follow up letter I sent you earlier today regarding this office's response dated October 11, 2023 to your OPRA request dated October 1, 2023, that email is merely advising that responsive records do exist in response to request (3) of that request, however, those responsive records are exempt from the provisions of the Open Public Records Act on the basis of being criminal investigatory records and thus cannot be released in response to an OPRA request.
Regarding the content of the discovery in the criminal matter associated with your requests, I would advise that you speak to the attorney representing the defendant in that matter who is in receipt of the discovery, as I am unfamiliar with the contents of the discovery in that matter and am not involved in that criminal matter.
