Dear Ms. Bloom:

The District is in receipt of your request for records under the Open
Public Records Act.  Specifically, your request sought:

“An Advisory Opinion issued between April and June 2022, to the Monroe
Township School District (Middlesex) Board of Education Member and/or its
in-house attorney, Vito Gagliardi by the NJSBA, regarding a possible
conflict of interest involving a Board member and their spouse who is an
outspoken critic of the current Acting Superintenent, where the advisory
opinion was sought to determine whether or not this Board member would
need to recuse herself from any Superintendent search and/or evaluation
involving the current Acting Superintendent.”

Please be advised that your request for an “advisory opinion” to the
Monroe Township Board of Education issued to Special Counsel Vito
Gagliardi by the New Jersey School Boards’ Association is denied as any
such record would be exempt from disclosure under OPRA pursuant to the
recognized exemption for records falling within the attorney-client
privilege. In addition, your request is denied as such record, if it
existed, would be exempt from disclosure pursuant to OPRA’s advisory,
consultative, or deliberative material exception.  N.J.S.A.47:1A-1.1
(providing that the definition of a government records "shall not include
inter-agency or intra-agency advisory, consultative, or deliberative
material"). Finally, your request is also denied as the District has no
records responsive to your request.
