Please accept this as my request for government records under both OPRA
and the common law right of access.  Thank you very much for your
commitment to transparent government.

BACKGROUND:

The sixth page of the Hardyston Police Department's 2022 Appendix K (i.e.
the 2022 Internal Affairs Summary Report) shows that two new "theft"
cases, one filed by a civilian and one filed by the agency, were opened in
2022.  I cannot tell if they relate to the same or different instances. 
N.J.S.A. 47:1A-3(b) states that "[n]otwithstanding the provisions of
[OPRA], the following information concerning a criminal investigation
shall be available to the public within 24 hours or as soon as
practicable, of a request for such information: where a crime has been
reported but no arrest yet made: information as to the type of crime,
time, location and type of weapon, if any."  Since no criminal process has
issued (per your February 24, 2023 response to my prior OPRA request, then
it follows that I am entitled to this information because no arrests have
yet been made.
