Dear Highlands Borough,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

Records requested:
Access is requested to the following existing government records maintained by the Highlands Fire Department for calendar year 2025 (January 1, 2025 through December 31, 2025).

1. NFIRS Incident Reports or Highlands Fire Department
All NFIRS (National Fire Incident Reporting System) incident reports that were created, submitted, transmitted, or exported by the Highlands Fire Department for incidents occurring during calendar year 2025.

2. NFIRS System-Generated Records
All existing, system-generated NFIRS records reflecting NFIRS reporting activity by the Highlands Fire Department during calendar year 2025, including, to the extent such records exist:
- NFIRS submission or transmission logs
- Incident number logs
- Export files (PDF, XML, CSV, or similar formats)
- Audit logs
- Submission confirmations
- System-generated summary or activity reports

3. If No NFIRS Reports Were Submitted in 2025
If no NFIRS incident reports were submitted during calendar year 2025, please provide either:
any existing records documenting that no NFIRS reports were submitted for that year, or
a certification of non-existence identifying the system(s) searched (including NFIRS), the date range searched, and the personnel who conducted the search.

Additional Clarifications

This request is not limited to any specific address, property, or incident.

This request seeks existing electronic records only.

This request does not seek analysis, explanations, opinions, summaries, or the creation of new records.

If responsive records are maintained electronically, electronic production is requested.
If no responsive records exist, a certification of non-existence is requested in accordance with OPRA.

Fee Clarification

Because the records requested are existing, system-generated electronic records maintained in NFIRS or connected reporting platforms, this request does not require extraordinary expenditure of time or effort, and no special service charge or search fee is authorized under N.J.S.A. 47:1A-5(c).

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Please be advised that it has been determined that the
Borough's production of records responsive to this
request will involve an extraordinary expenditure of time
and effort, and therefore a special service charge will
be required prior to search and production of responsive
records pursuant to N.J.S.A. 47:1A-5. The estimated time
required for a response, and the lowest hourly rates - of
the qualified employees capable of performing the task -
of the employees involved, are as follows:

• Clerk: 20 hours at $43.78 per hour

Accordingly, a deposit of $875.60 will be required prior
to commencement of the search for and production of
responsive records. You can pay online by credit card or
e-check by selecting "OPRA Fee" at
www.highlandsnj.gov/PayClerk.

Failure to respond to this request for confirmation
within 1 day will result in the denial of the request.
