New Jersey Open Public Records Act Request: Body-Worn Camera, Dash Camera, and Rear Seat Camera Footage – Arrest of Samantha Pennant (April 11, 2024)

Dear Raritan Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I respectfully request access to and copies of all video recordings related to the detention and arrest of Samantha Pennant on or about April 11, 2024, at approximately 10:51 AM, at or near the Raritan Train Station, Raritan Borough, New Jersey.

Specifically, I request:

All body-worn camera footage recorded by Raritan Borough Police Department personnel during their initial approach to Pennant, the identification process, her resistance during arrest, and any subsequent transport to custody.

Any dash camera footage from patrol vehicles involved during the initial contact (if applicable).

Any rear seat (transport vehicle) camera footage capturing Samantha Pennant following her arrest.

The requested footage should cover events shortly before, during, and after officers’ arrival at the Raritan Train Station, Pennant’s interactions with officers, her provision of false information, her resistance during custody, and her transport. If multiple officers or recording devices captured footage, I respectfully request copies from each.

If any footage is proposed for redaction or withholding, please notify me in advance with a specific legal justification under OPRA. Given the significant public interest in documenting police encounters involving arrest resistance and identity falsification, I request disclosure to the fullest extent permitted by law.

I respectfully request that any fees be waived, as this request is made in the public interest for news reporting and transparency purposes. If there are any fees associated with this request, please inform me before proceeding. I prefer to receive the records electronically if possible.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
