Dear Hoboken City,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I respectfully request access to and copies of all video recordings related to the detention and arrest of James Foley on or about April 20, 2024, at approximately 9:50 PM at Dino and Harry’s Steakhouse, 163 14th Street, Hoboken, New Jersey, and subsequently at Hoboken Police Headquarters.

Specifically, I request:

All body-worn camera footage recorded by Hoboken Police Department personnel during their initial response at Dino and Harry’s, the physical interaction with Foley, the arrest, and subsequent transport.

Any rear seat (transport vehicle) camera footage capturing James Foley after his arrest and during transport to Hoboken Police Headquarters.

Any available footage from the booking or processing room capturing James Foley’s actions, including alleged spitting of blood and verbal threats toward officers.

The requested footage should cover the period shortly before, during, and after officers’ arrival at Dino and Harry’s; Foley’s interactions with staff and patrons; the physical altercation and arrest; his transport to headquarters; and his actions while in custody at the station. If multiple officers or recording devices captured footage, I respectfully request copies from each.

If any footage is proposed to be redacted or withheld, please notify me in advance with a specific legal justification under OPRA. Given the strong public interest in documenting law enforcement interactions involving use of force, contamination of evidence (spitting blood), and threats against officers, I request full disclosure to the maximum extent permitted by law.

I respectfully request that any fees be waived, as this request is made in the public interest for purposes of news reporting and public transparency. If there are any fees associated with this request, please inform me before proceeding. I prefer to receive the records electronically if possible.

My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.
