New Jersey Open Public Records Act Request: Body-Worn Camera, Dash Camera, and Rear Seat Camera Footage – Arrest of Justin Morris at CKO Gym (July 14, 2023)
Dear Hoboken City,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Pursuant to the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.), I respectfully request access to and copies of all video recordings related to the detention and arrest of Justin Morris on or about July 14, 2023, at approximately 9:05 AM, at CKO Gym, Madison Street, Hoboken, New Jersey.
Specifically, I request:
All body-worn camera footage recorded by Hoboken Police Department personnel during their response, initial contact, attempted disarmament, physical struggle, and arrest of Justin Morris inside the gym.
Any dash camera footage from patrol vehicles arriving at the scene (if available).
Any rear seat (transport vehicle) camera footage capturing Justin Morris following his arrest and during transport to Hoboken Police Headquarters.
The footage should include events shortly before, during, and after officers' arrival, the verbal interaction inside the gym, Morris's attempt to grab an officer’s firearm, the physical struggle, assistance from gym members, the arrest, and any transport. If multiple officers or vehicles were present, I respectfully request footage from each device.
Important Notice Regarding Redactions:
If any footage is proposed to be redacted or withheld, I respectfully request advance notification and a specific explanation citing the legal basis for each redaction or denial. Given the significant public interest in ensuring accountability in cases involving attempted disarmament of law enforcement officers and civilian intervention, I request that recordings be released to the fullest extent permissible under OPRA.
I am willing to pay any reasonable duplication fees. Please provide the requested records electronically if possible.
