I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Records requested:

Pursuant to OPRA and, alternatively, the common law right of access, I request the following existing records relating to the New Jersey Division of Fire Safety report entitled “Career Firefighter Severely Burned While Operating at a Structure Fire, Asbury Park, New Jersey, January 10, 2011,” issued February 1, 2014:

- The City’s copy of the final report, including any transmittal letter, attachments and distribution records.
- Records identifying the City officials and Fire Department personnel who received the report.
- Final corrective-action plans, implementation plans, compliance reports, written responses, memoranda, policies, standard operating guidelines, general orders or training directives created or revised in response to the report.
- Final records identifying whether each factor, remedy, lesson learned or recommendation contained in the report was accepted, implemented, rejected, deferred or considered complete.
- Final written communications transmitted by the City or Fire Department to the Division of Fire Safety, Department of Community Affairs, Department of Labor and Workforce Development, PEOSH or any other state agency concerning compliance with or implementation of the report.
- Inspection reports, citations, notices of violation, abatement records, settlement records or final findings issued by the New Jersey Department of Labor and Workforce Development or PEOSH concerning the January 10, 2011 incident or the conditions discussed in the report.
Final staffing, accountability, incident-command, rapid-intervention, recall, communications, personal-protective-equipment or mutual-aid policies revised following the incident or report.
- Training records sufficient to show the dates and subjects of department-wide training conducted in response to the final report, without disclosure of personal medical information or individual test results.
- Final reports, memoranda or command-staff presentations dated February 1, 2014 through the present that cite, reference, discuss or evaluate the 2014 report.
- Records reflecting any subsequent review by the Division of Fire Safety, PEOSH, an insurer, a joint insurance fund or a risk-management entity concerning whether the remedial measures identified in the report were implemented.

This request does not seek individual medical records, private personnel information or the creation of a new compliance analysis. It seeks existing records documenting the City’s response to a specifically identified state serious-injury report.
