Dear New Brunswick Housing Authority,

Under the OPRA and the common law right of access, please provide a copy of the 2023-24 DCA budget as introduced by the NBHA Board of Commissioners in NBHA RESOLUTION 2023 – 5/24 #19.

I must note that in response to a prior request for the prior year's budget, the NBHA incorrectly that the State of New Jersey had "not yet returned" the budget document in question and that the authority was therefore "currently unable to provide the requested record." This statement was provided to me on August 2, 2023, at least five months after the Division of Local Government Services (DLGS) had approved the document.

I have since communicated with DLGS spokesperson Tammori Petty-Dixon, who corrected the record and stated: "Once the budget is introduced, it is a public document." As such, please provide the NBHA's FYE 6/30/2024 state budget immediately pursuant to the OPRA.

Dear Mr. Toto,

Unfortunately, your predecessor Mr. Clarke left several of my pending OPRA requests unfulfilled, and the authority has been recklessly risking legal liability by not complying with the state statute NJSA 47:1A.

The NBHA never responded to my August 9 request for the 2023-24 DCA budget as introduced by the NBHA Board of Commissioners in NBHA RESOLUTION 2023 – 5/24 #19. Please provide the requested record.
