Your request sought access to the following:
1. All NEMSIS records for the Borough of Middlesex for years 2019, 2020,
and 2021 as defined in N.J.S.A. 26:2K-67.b
Please be advised that your request requires clarification. When a
request does not name specifically identifiable records or is overly
broad, a custodian may deny access pursuant to the following court
decisions: MAG Entertainment, LLC v. Division of Alcoholic Beverage
Control, 375 N.J.Super. 534 (App. Div. 2005). A proper request under OPRA
must identify with reasonable clarity those documents sought. A custodian
is obligated to search and find the identifiable government records listed
in the Complainant`s OPRA request. A custodian is not required to research
her files to figure out which records, if any, might be responsive to a
broad and unclear OPRA request. Please clarify whose records (Middlesex
Borough Rescue squad, Police Department etc.,) you are requesting, as the
Borough of Middlesex does not have a hospital.

Good Morning,
As noted below, we requested clarification on October 27th. Your request was too broad. Please clarify whose records (Middlesex Borough Rescue squad, Police Department etc.,) you are requesting, as the Borough of Middlesex does not have a hospital. The seven business day deadline to respond to your request begins the after said clarification is received.

The referenced statute has no relation to hospitals. For ease of access, I have provided the statue, as referenced earlier, below:
b. Each emergency medical services dispatch center shall report to the department, in a standardized format as the commissioner shall prescribe by regulation, the following information concerning each request for emergency medical services received by the dispatch center:
(1) The date, time, and location of the request for emergency medical services;
(2) The nature and circumstances of the emergency, as provided to the dispatch center;
(3) The identity of each emergency medical services provider dispatched to the scene of the encounter; and
(4) Any other particulars of the request as may be relevant or as may be required by the commissioner.
It is likely the Borough does not directly hold these records as this service is contracted to RWJ HeathNetwork and will have to be requested from them. As the contractor does fall under the above mandated reporting standard, it is understood that these records would be readily available.

The Borough of Middlesex received your Open Public Records Act (OPRA) request on October 27, 2021. The official Records Custodian, Linda Chismar, received your OPRA requests on October 27, 2021. A request for clarification was sent to you on October 27, 2021. We received your clarification on November 9, 20201. As such, the seven (7) business day deadline to respond to your requests is November 19, 2021. This response is being provided to you on the same business day after custodian’s receipt of said clarification.
Your request sought access to the following:

Please be advised that the police department does not dispatch emergency medical calls and does not have such records on file. RWJ Somerset took over our emergency medical dispatch during the time period requested. At this time, I believe your request has been fulfilled.

The contract for dispatch is currently with RWJ Health Network, a private non-profit, which dispatches through their communications center Med Central. The contract executed states that all work completed will be completed within the confines of the laws of the State of New Jersey.
As it is assumed that the Borough has ensured compliance with statutes governing this service by the service vendor and whereas the vendor agrees to be available to the administration, it would be reasonable to assume that these records - which ensure that the residents and visitors are receiving adequate EMS service - would be readily available.
If these records are not currently held by the Borough, it is kindly requested that the Borough ascertain them to ensure both contract compliance and that appropriate care is reaching those in need in a timely fashion. It would be of great concern if the Borough could not ascertain these records to be provided as it would shield these industry KPI's from public view given the understanding that RWJ Health Network is a private entity not clearly falling under the jurisdiction of OPRA.
