Dear Cumberland County Prosecutor's Office,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

On October 13, 2023 I requested the number of Cyber-Tips received from the NJ State Police in 2019 and the number of arrests made as a result of those arrests.

On October 24, 2023, AP Stephen Sayer denied the request because:

"To the extent that this is a request for information, or for a new document to be created in
response to your request, this request is denied as an impermissible request for information and research and for the creation of a new record, where you have failed to request a specifically identifiable record that can be simply turned over in response to your request and have instead requested information in the form of how many Cyber Tips this office has received in the year 2019, the number of arrests that were made as a result of cyber tips received during the year 2019, and the amount of grant funding received during the year 2019 for your specified task force. If a request does not name specifically identifiable records or is overly broad, a custodian may deny access pursuant to the following court decisions:....."

On November 6, 2023 I respectfully requested a copy of the MOU signed between the Cumberland County P.O. and the NJ State Police.

On November 17, 2023, AP Sayer responded with a copy of the MOU to participate in the Internet Crimes Against Children (ICAC) Task Force.

I am respectfully referring you to Page 4 of the MOU and the reporting requirement:

"Reporting
By the fifth (5th) day of each month a designee from each participating agency shall report all statistics pertaining to ICAC Investigations, on the attached monthly reporting form, which will be kept on record by the ICAC Commander. All statistics will be combined on a New Jersey Regional ICAC Task Force form and delivered to the ICAC Grant Program Manager at OJJDP. Bi-Annually during the FFY, the ICAC Commander must outline the current project and report on outstanding investigations conducted during this six (6) month period. Each participating agency will highlight those investigations conducted by their investigators and forward them to the ICAC Commander for the Bi-Annual Report. "

The specific records identified are probably entered using the ICAC Data System in 2023, but regardless, they are specified and identified records covered by the OPRA.

Kindly review and release the records for the 2019 Cyber-Tips, Arrests made as a result of those Cyber-Tips and any grant funding received by the CCPO.
