Dear Mr. Kratovil:

I write in response to your request for “all text messages or email
messages sent from Nancy Pinkin to David Wildstein or vice versa during
the time period since Ms. Pinkin assumed the office of County Clerk.”  I
note that the request identifies the sender/ recipient and the date range
of the correspondence to be located but does not specify the subject
matter being sought. 

Requests for communications require the requestor to identify (1) the
content and/or subject of the e-mail, (2) the specific date or range of
dates during which the e-mail(s) were transmitted, and (3) the identity of
the sender and/or the recipient thereof. See also Sandoval v. N.J. State
Parole Bd., GRC Complaint No. 2006-167 (Interim Order March 28, 2007).
 Requests seeking correspondence or communications but omitting the
specific parameters such as date range are invalid. See Tracey-Coll v.
Elmwood Park Bd. of Educ. (Bergen), GRC Complaint No. 2009-206 (June
2010); Kohn v. Twp. of Livingston (Essex), GRC Complaint No. 2013-118
(January 2014).  In Ciszewski, the GRC determined that a request failing
to contain the subject or content of the correspondence sought was
invalid. See Ciszewski v. Sparta Police Dep’t (Sussex), GRC Complaint No.
2013-79 (October 2013); Ciszewski v. Newton Police Dep’t (Sussex), GRC
Complaint No. 2013-90 (October 2013).

Insofar as the request for correspondence fails to include the subject
matter it is not a valid OPRA response.  Please specify the subject matter
or key words to be searched and we will process the request accordingly.

Dear Mike,
I appreciate you sending some messages that were requested. I'll note that the messages were in a 4-page .pdf file , and a single .jpg image.

Unfortunately, there are gaps in the messages and due to the poor quality of the images, I can't read all of what has been provided.

For example, on page 1 of the .pdf there is a text message from December 3 that is only partially visible. Page 2 of the file picks up with a different message, for which it's impossible to see the date and time sent. That page ends with a message that is truncated, though it appears to be included in full on page 4. Page 3 begins with the end of a message, which makes it a mystery when that message, and the follow-up response from Mr. Wildstein were sent. The .jpg image sent appears to be a duplicate of page 3 from the .pdf. In both files, this page is difficult to read because of a glare reflecting off of the screen. I think I can figure out what the messages say based on context clues, but perhaps it would be better to use the "screenshot" feature on the phone in question, rather than taking photographs of the phone.

Please provide complete copies of the messages in question to fulfill my request. Thank you.
