Good afternoon,
I am following up on an OPRA request you sent to my office.
In response, I sent you an email advising that an extension of 7
additional days is needed to fulfill the request, bringing the due date
to March 7^th. The reason for the extension is due to the fact that the
video footage requested is voluminous and it will take time for review and
redaction of any responsive videos that exist.
Given the time needed for a member of the Police Department to review and
redact any responsive videos, a special service charge must be imposed.
The estimated cost of the special service charge is $165.00, which
represents three (3) hours of time at the relevant officer’s overtime rate
of $55.01 per hour. However, the actual amount due could be more or less
than that depending upon how long it actually takes the officer to finish
the review and redaction process. Notwithstanding the estimate
referenced, you will be responsible for the actual cost based upon the
actual amount of time spent multiplied by the sum of $55.01 per hour.
If you wish to proceed, then a deposit of one-half of the estimated cost
of the special service charge (or $82.50) will be required at this time.
The remainder must be paid at the time of pick-up of the video(s). Please
note that, due to the volume of the video footage requested, the video(s)
shall be provided on a thumb drive.
In the meantime, my office will seek to provide a response to you relating
to any of the other non-video requests as soon as possible, and no special
service charge shall be required for those records.
Please advise if you wish to continue with the request for all of the
video footage referenced in your OPRA request.
If so, please provide the sum of $82.50, as referenced above. Upon
receipt of your payment in that amount, we will commence the review and
redaction process relating to the video(s) requested.
