Mullaney Whistleblower Legal Fees - SECOND OPRA Request

S Cohen made this OPRA request to Livingston Township Automatic anti-spam measures are in place for this older request. Please let us know if a further response is expected or if you are having trouble responding.

We're waiting for S Cohen to read recent responses and update the status.

Dear Livingston Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

I previously asked for:

"1. A cumulative total of all legal fees accrued by the Township to date relating to the Kevin Mullaney Police Whistleblower Matter

2. An itemized list of money spent on each attorney/law firm"

My request was evaded with an improper response:

"There are no responsive documents as the Mullaney matter is covered by the
GSMJIF, and not paid out of pocket by the Township. All legal fess are
covered by insurance."

This is now my second request for this data. The GSMJIF will not cut a blank check. There must be a ledger of billable hours dedicated for this matter. This is what I am seeking:

1. Breakdown of billable hours - either to be paid for by the town or by the GSMJIF - tallying the amount of money spent or scheduled to be spent for the Mullaney whistleblower matter. Who pays the bill is irrelevant.

2. A list of all attorneys involved in this issue that are paid by the Township of Livingston and/or the GSMJIF. Mullaney's attorney does not apply because I imagine he is paying for him.

Yours faithfully,

S Cohen

Livingston Township

Dear S Cohen,

Per your OPRA and common law request received Thursday, August 22, 2024,
please see our response below in bold:

I previously asked for:

"1. A cumulative total of all legal fees accrued by the Township to date
relating to the Kevin Mullaney Police Whistleblower Matter

2. An itemized list of money spent on each attorney/law firm"

My request was evaded with an improper response:

"There are no responsive documents as the Mullaney matter is covered by
the GSMJIF, and not paid out of pocket by the Township. All legal fees are
covered by insurance."

This is now my second request for this data. The GSMJIF will not cut a
blank check. There must be a ledger of billable hours dedicated for this
matter. This is what I am seeking:

1. Breakdown of billable hours - either to be paid for by the town or by
the GSMJIF - tallying the amount of money spent or scheduled to be spent
for the Mullaney whistleblower matter. Who pays the bill is irrelevant.
The Township does not have bills sent to the GSMJIF and is not a record
holder for GSMJIF; therefore, as stated in the response to your previous
request, there are no responsive documents that can be produced by the
Township.

2. A list of all attorneys involved in this issue that are paid by the
Township of Livingston and/or the GSMJIF. Mullaney's attorney does not
apply because I imagine he is paying for him. Please see attached file.

Sincerely,

Township Clerk's Office
