Dear Piscataway Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.

requestor shall be advised by the custodian when the record can be made

Good morning,
After careful review, your request is denied for the reasons set forth
below.
Pursuant to the N.J.S.A. 47:1A-9(a)-(b) and Prevention of Domestic
Violence Act, N.J.S.A. 2C:25-33, all domestic violence records are deemed
confidential and “shall not be made available to any individual or
institution except as otherwise provided by law.” The Government Records
Council has expressly affirmed that this statutory confidentiality
provision supports the lawful denial of OPRA requests for records relating
to domestic violence incidents. See Butala v. Township of Aberdeen, GRC
Complaint No. 2014-194.
Additionally, the requested body-worn camera recording constitutes a
criminal investigatory record within the meaning of N.J.S.A. 47:1A-1.1, as
it was created by law enforcement in response to, and in furtherance of, a
law-enforcement investigation. Criminal investigatory records are
expressly excluded from the definition of “government records” subject to
disclosure under the Open Public Records Act (“OPRA”), unless another
statute affirmatively requires their release. No such statute applies
here.
Further, the requested footage is exempt from disclosure pursuant to the
Body-Worn Camera Law, N.J.S.A. 40A:14-118.5, which limits public access to
body-worn camera recordings and authorizes nondisclosure where release
would implicate privacy interests, victim safety concerns, or
law-enforcement considerations. The footage at issue involves a reported
domestic-violence incident and contains highly sensitive information.
Disclosure under OPRA would therefore be inconsistent with the statutory
protections afforded under this law.
Accordingly, the request is denied.
