RE: OPEN PUBLIC RECORDS REQUEST of November 13, 2020, Reference #
R003332-111320
Abdul Hai:
The City received a public information request from you on November 13,
2020. Your request mentioned:
Dear Jersey City,
This is a request for public records made under OPRA and the common
law right of access. I am not required to fill out an official form.
Please acknowledge receipt of this message.
Records requested:
What media monitoring do you conduct?
Can you publish any reports you have produced?
What is the cost per year?
Yours faithfully,
Abdul Hai
Your OPRA request constitutes as a request for information, not documents.
Therefore, your request is denied pursuant to MAG Entertainment, LLC v.
Division of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div.
2005) and Bent v. Stafford Police Department, 381 N.J. Super. 30 (App.
Div. 2005)." The New Jersey Superior Court has held that "[u]nder OPRA,
agencies are required to disclose only "identifiable" government records
not otherwise exempt." MAG Entertainment, LLC v. Division of Alcoholic
Beverage Control, 375 N.J. Super. 534, 549 (App. Div. 2005). Furthermore,
in Bent v. Stafford Police Department, 381 N.J. Super. 30, 37 (App. Div.
2005), the Superior Court references MAG in that the Court held that a
requestor must specifically describe the document sought because OPRA
operates to make identifiable government records "accessible." "As such, a
proper request under OPRA must identify with reasonable clarity those
documents that are desired[.]"
In view of the foregoing your request is now closed.
Sincerely,
Amanda Bransky
