The Borough of Little Silver Custodian of Records received your OPRA
request after business hours on Monday, September 12, 2022.  The Little
Silver Police Department’s Records Clerk received your OPRA request on
Tuesday, September 13, 2022.  This response is being provided to you on
the fifth business day of the Custodian’s receipt of said request which is
within the seven (7) day period to respond.  Your OPRA request sought
access to the following:

·         “information related to the May 2, 2021 arrest of Elizabeth E.
Buchanan by Patrol Officer Christopher Ibarra.  Please provide everything
available related to the arrest including but not limited to body camera
footage, photographs, all written notes both by print ad handwritten, all
reports, photographs, video footage, citations, etc. the complete record.”

Your request requires additional time beyond the seven (7) business days
to fulfill as permission from the Monmouth County Prosecutor’s Office is
required in order to release Body Cam footage and further record
inspection is necessary.  OPRA allows custodians to seek extensions of
time pursuant to N.J.S.A. 47:1A-5.1.  Specifically, OPRA states that, “the
requestor shall be advised by the custodian when the record can be made
available.  If the record is not made available by that time, access shall
be deemed denied.”

Your request requires an extension of an additional seven (7) business
days (September 30, 2022).  If these records become available prior to the
extension date, same will be forwarded to you at that time.

If your request for access to a government record has been denied or
unfilled within the seven (7) business days required by law, you have a
right to challenge the decision by the Borough of Little Silver/Little
Silver Police Department to deny access. At your option, you may either
institute a proceeding in the Superior Court of New Jersey or file a
complaint with the Government Records Council (GRC) by completing the
Denial of Access Complaint Form.  You may contact the GRC by toll-free
telephone at 866-850-0511, by mail at P.O. Box 819, Trenton, NJ, 08625, by
