Dear Ms. Bukachevsky,
The Township of Edison has had opportunity to review and process your
February 15, 2018 OPRA Request, which requested the:
“Results of a sound study performed by Maser Engineering Consultants at
the Seagis/Amazon warehouse on 2170 Route 27 and surrounding areas
(Outcalt Rd./Elizabeth Ct./Caldwell Rd.) during the months of January and
February 2018.”
Please be advised that your request for the Maser study is denied at this
time. The Maser study, when completed, will be used by the Township at
least initially for internal advisory, consultative and/or deliberative
(“ACD”) analysis respecting the Seagis/Amazon facility. Under N.J.S.A.
47:1A-1.1 within the Open Public Records Act, a disclosable government
record shall not include “inter-agency or intra-agency advisory,
consultative, or deliberative material”. Insofar as the Maser study will
be utilized for Township internal ACD analysis, it is not disclosable at
this time. The Township expects that the report may become disclosable at
a later date once all options pertaining to the study have been reviewed.
You have the right to challenge the Township’s determination if you
believe that course appropriate. At your option, you may either institute
a proceeding in the Superior Court of New Jersey, or file a written
complaint with the New Jersey Government Records Council (GRC). You may
