Dear North Bergen Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

Dear Skittles:

The Township of North Bergen (the “Township”) received your request dated 01/16/2026 under the New Jersey Open Public Records Act (“OPRA”), N.J.S.A. 47:1A-1 et seq.

“Records requested:
Any and all records/reports regarding any Major Discipline against Lt. Alex Guzman from the North Bergen Police Department.

The Township responds:

In accordance with Section 9.6.2 (a) of the Internal Affairs Policy and Procedures (New Jersey Attorney General, Revised November 2022), the Internal Affairs Summary and Conclusions Report described in Section 9.1.1(b) shall be released in response to a request made under the common law right of access by any member of the public or press where it satisfies any of the following conditions:

(1) The Summary and Conclusions Report led to a result on or after January 1, 2023, that requires disclosure pursuant to Section 9.11.2;

(2) The agency otherwise concludes that the Summary and Conclusions Report is subject to release pursuant to applicable law or court order; or

(3) Upon the request or at the direction of the County Prosecutor or Attorney General at any time.

Accordingly, attached please find responsive record entitled North Bergen Major Discipline Report Appendix L 2025- LT Guzman.

The remainder of your request is denied pursuant to N.J.S.A. 47:1A-9 (Section 9.6.1 of the New Jersey Attorney General Internal Affairs Policy & Procedures (November, 2022)), which states that the nature and source of internal allegations, the progress of internal affairs investigations, and the resulting materials are confidential information and remain exempt from access under the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1.1 to -13.
Requests for “any and all records / reports regarding” a particular subject matter are improper under OPRA. A valid OPRA request must seek a specifically identifiable record that does not require a custodian to research files to determine which records are responsive. OPRA requires a requestor to seek access to specific, identifiable government records. The request for “records” does not identify any particular government record, but instead requires custodian to conduct research and review an indefinite number of documents to determine any potential responsiveness. Your request for “any and all records” is denied pursuant to the following court decisions: MAG Entm’t, LLC v. Div. of Alcoholic Beverage Control, 375 N.J. Super. 534 (App. Div. 2005), Bent v. Stafford Police Dept, 381 N.J. Super. 30 (App. Div. 2005), N.J. Builders Ass’n v. N.J. Council on Affordable Hous, 390 N.J. Super. 166 (App. Div. 2007), and Schuler v. Borough of Bloomsbury, GRC Complaint No. 2007- 151 (February 2009).

As with any OPRA request, you have the right to challenge the decision by the Township. At your option, you may either institute a proceeding in the Superior Court of New Jersey or file a complaint with the Government records Council (“GRC”) by completing the Denial of Access Complaint Form.
