Dear Middlesex Borough,
Under OPRA and the common law right of access, please provide copies of:
1) all approved applications for long-term tax exemptions (LTTE's), including cover letter, attachments/exhibits, and other accompanying documentation, including receipt/proof of payment for the administrative review fee
2) the ordinances approving each such tax exemption and the financial agreements, including all attachments/exhibits, and other accompanying documentation, for each
3) records sufficient to show the dates and amounts of all payments in lieu of taxes (PILOT's) made in connection with each such tax exemption
4) the most recent financial statement provided by each approved urban renewal entity
5) records sufficient to show the current assessed value of each LTTE property and the date(s) that certificate(s) of occupancy were granted for each

The Borough of Middlesex received your Open Public Records Act (OPRA) request on September 8, 2020. The official Records Custodian, Linda Chismar, received your OPRA requests on September 8, 2020 . As such, the seven (7) business day deadline to respond to your requests is September 17, 2020. This response is being provided to you on the 5th business day after custodian’s receipt of said request.
Your request sought access to the following:

After further review of your OPRA request, it has been determined that clarification is required as to item #5 of your request. Please clarify if you are seeking the dates the Certificate of Occupancy were granted for the Building Structures or for ALL the individual apartments, so that we may process your request. The seven (7) business day deadline to respond to your request begins on the 1st day after receipt of your clarification.

Dear Ms. Modica,
Good question. I would say whichever C.O.(s) triggered the commencement of the tax exemption under the financial agreement. Not having seen the agreement, I can't be sure what it states on this point.
