Locations of Flock Cameras in Woodbridge TWP

We're waiting for Emily Hoagland to read a recent response and update the status.

Dear Woodbridge Township,

Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-5(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.

I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.

I WILL NOT use the requested government records for a commercial purpose.

I AM NOT seeking records in connection with a legal proceeding.

Dear Requestor:

Your Open Public Records Act (“OPRA”) request seeking the locations of Flock
Automated License Plate Recognition (“ALPR”) cameras is hereby denied.

The requested information is not subject to disclosure under OPRA because the
specific locations of law-enforcement ALPR cameras constitute information
maintained and utilized for law-enforcement and criminal investigative purposes.
Disclosure of the precise locations would reveal operational surveillance
capabilities and could reasonably be used to identify and avoid areas of
law-enforcement monitoring, thereby impairing the effectiveness and intended
purpose of the system.

Pursuant to N.J.S.A. 47:1A-1.1, a “criminal investigatory record” is defined as
a record that is not required by law to be made, maintained, or kept on file and
that is held by a law-enforcement agency and pertains to a criminal
investigation or related civil enforcement proceeding. Criminal investigatory
records are expressly exempt from disclosure under OPRA.

Additionally, N.J.S.A. 47:1A-3(a) permits access to records pertaining to an
investigation in progress to be denied when disclosure would be inimical to the
public interest. Disclosure of the precise locations of law-enforcement ALPR
cameras would be contrary to the public interest where such disclosure could
facilitate the avoidance or circumvention of law-enforcement surveillance and
investigative capabilities.

The requested camera-location information is therefore being withheld as
criminal investigatory and law-enforcement operational information pursuant to
N.J.S.A. 47:1A-1.1 and, where applicable, N.J.S.A. 47:1A-3
