Livingston Police Department Records Request
Dear Livingston Township,
Please accept this electronic request for public records made under OPRA and the common law right of access. I am not required to fill out an official form or use a particular software platform to submit my request per NJSA 47:1A-6(f), which states that an email from a requestor including all of the information required on the adopted form shall suffice in place of a completed form as a valid government record request.
I HAVE NOT been convicted of any indictable offense under the laws of New Jersey, any other state, or the United States.
I WILL NOT use the requested government records for a commercial purpose.
I AM NOT seeking records in connection with a legal proceeding.
Records requested:
Incident/arrest reports including officer narrative that have been coded as DUI/DWI from 05/01/2024 to 05/14/2024.
My preferred delivery method for response(s) to this request is by E-mail as attachments. Please confirm you have received this request. If you are not the custodian of records, please forward my request to that person and provide their email address to me for future reference.

Pursuant to NJSA 47:1A-5(i), you shall receive a response as soon as possible, but not later than seven (7) business days. If you are seeking records for "a commercial purpose" as defined in NJSA 47:1A-1.1, you shall receive a response as soon as possible, but not later than 14 business days. Day one starts the day after the request has been received (Holidays and Town Hall closings do not count as business days).

The police department has responded as follows in response to your request
for records made under OPRA and the common law right of access for:
"Incident/arrest reports including officer narrative that have been coded
as DUI/DWI from 05/01/2024 to 05/14/2024."
I have conducted searches based upon the requestors parameters,
specifically;
"Incident/arrest reports including narrative that have been coded as
DUI/DWI from 05/01/2024 to 05/14/2024".
I have searched by CAD entry code for a DWI / DUI ( Code CFS 21) within
the date range with negative results.
To be sure, I then searched by arrests within the date range in the event
that a DWI /DUI arrest occurred under a different code entry that may not
have been changed to reflect the arrest (ie: MVA with a DWI/DUI Arrest).
This search determined there to be Eleven (11) arrests within the time
period in the reqeust. A manual review of each of these arrests in the
system disclosed Five (5) for Shoplifting, Three (3) for Disorderly
Conduct / Harassment, One(1) for Theft, One (1) for Criminal Mischief and
One (1) for a Violation of a Temp. Restraining Order. None were for DWI /
DUI.
Based upon these searches as conducted, it does not appear that we possess
any records responsive to this request as written.
