The records are due on Thursday, Sept. 24, 2021. I would normally agree to an extension but, as you know, there is pending litigation that relates to these public records. As such the records are time-sensitive and I cannot wait beyond Friday, Sept. 24, 2021. Also, please note that "If a custodian cannot provide immediate access to records for a legitimate reason, the custodian must reduce such reason to writing and request an extension of time to comply with the immediate statutory requirement." Pursuant to OPRA law, this request is deemed a denial of records. This request was submitted on September 15, 2021 and due on September 24, 2021. On September 21, 2021, a 1-week extension was requested to which I replied that the records were time-sensitive and that I could not wait beyond Friday, Sept. 24, 2021. I received no reply. The 1-week extension that was "requested" on September 21, 2021, would have been due on October 1, 2021. Furthermore, despite unilaterally granting itself an extension of time to respond to an OPRA request, no records were received from the Township of Mansfield until October 8, 2021, 10-days beyond the due date and 5 days beyond the unilaterally granted extension of time. Under the Open Public Records Act: "The Custodian's failure to grant or deny access to the requested records by the extended deadline date results in a deemed denial of the request".
