List of Properties

The request was partially successful.

Dear Denville Township,

This is a request for public records made under OPRA and the common law right of access. I am not required to fill out an official form. Please acknowledge receipt of this message.
Records requested:

- A list of all properties that have had fires occur, or have had emergency calls to the property since the beginning of 2022
- A list of all property addresses that are currently vacant, abandoned, or boarded up.

Yours faithfully,

Nathan

Good morning:

You had submitted an Open Public Records Act (“OPRA”) request, which was
received by the Records Custodian on January 11, 2023   Please accept this
letter as the Custodian’s response pursuant to OPRA.

Your request sought access to the following:

• List of all properties that have had fires occur, emergency calls to
the property since the beginning of 2022.
• List of all property addresses that are currently vacant, abandoned or
boarded up.

The Township neither maintains a list containing the information you seek
nor is able to run an electronic report to provide the information.
Creating such a list would require research by the custodian, which is
not required under OPRA. See MAG Entm’t, LLC v. Div. of Alcoholic Beverage
Control, 375 N.J. Super. 534, 546, 549 (App. Div. 2005) (“OPRA simply
operates to make identifiable government records readily accessible for
inspection, copying, or examination.”); Lagerkvist v. Office of Governor
of State, 443 N.J. Super. 230, 237 (App. Div. 2015) (“OPRA does not
convert a custodian into a researcher.”) However, we have attached a list
of Fires in 2022 that we do maintain and is responsive to your request.

There are no other records responsive to your OPRA Request. This request
is now deemed complete and closed.

Regards,
